Terms of Service

By installing or using Club Builder (the “App”), you (“Merchant”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not install or use the App.

These Terms apply to all merchants who install Club Builder through the Shopify App Store or via a direct install link.

Club Builder is a Shopify application that provides:

• An embeddable product configuration widget for golf club customisation
• Dynamic pricing calculation based on selected options (shaft, grip, club set)
• Automatic cart price application via Shopify's Cart Transform Function API
• A merchant admin dashboard for managing products, options, and configurations

As a Merchant using Club Builder, you agree to:

• Provide accurate product and pricing information in the admin dashboard
• Ensure your Shopify store complies with all applicable laws and Shopify's Terms of Service
• Not use the App for any unlawful, fraudulent, or deceptive purpose
• Not attempt to reverse engineer, modify, or circumvent the App's functionality
• Keep your Shopify store credentials and access tokens secure

Club Builder may be offered on a free or paid basis as described in the Shopify App Store listing at the time of installation. Any applicable fees will be charged through Shopify's billing system in accordance with Shopify's billing policies.

We reserve the right to change pricing with reasonable notice. Continued use of the App after a price change constitutes acceptance of the new pricing.

All intellectual property rights in the App, including but not limited to the software, design, and documentation, remain the exclusive property of Club Builder. Installation of the App grants you a limited, non-exclusive, non-transferable licence to use the App solely for your own store operations.

You retain ownership of all product data, configurations, and content you create using the App.

We strive to maintain high availability of the App but do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including Shopify platform outages).

We are not liable for any loss of sales or revenue resulting from App downtime.

To the maximum extent permitted by applicable law, Club Builder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the App.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the fees paid by you to us in the three months preceding the claim.

You agree to indemnify and hold harmless Club Builder and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

You may terminate your use of the App at any time by uninstalling it from your Shopify store. We reserve the right to suspend or terminate access to the App if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the App, other merchants, or end customers.

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date above. Continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
